Under the Obama administration, the Department of Education’s Office of Civil Rights (known by the acronym OCR) pushed higher education institutions to prosecute sexual assault and rape cases without due process. Now, under the Trump administration and cabinet secretary Betsy DeVos, due process is making a return in the process at colleges and universities.
It is a rebuttal to the 2011 “Dear Colleague” letter, which allegedly institutionalized the avoidance of due process and prevalence of “kangaroo courts” (i.e. courts stacked against the accused) on college campuses.
